India Sets Date for Major Legal Overhaul, Exempts Rash Driving Provision

The Union Government announces July 1, 2024, as the commencement date for new criminal laws.

JAMSHEDPUR – The Union Government has officially announced that the new criminal laws – Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Adhiniyam – will take effect from July 1, 2024.

These laws aim to overhaul India’s criminal justice system by replacing the Indian Penal Code, the Code of Criminal Procedure, and the Indian Evidence Act, respectively.

The Ministry of Home Affairs issued three notifications today, marking a significant legal milestone.

However, a specific provision concerning rash and negligent driving has been put on hold due to widespread protests by truckers.

This provision is Sub Section (2) of Section 106 of the Bharatiya Nyaya Sanhita.

The decision to exempt this provision follows concerns from the trucking community about the severity of the penalties.

These laws were passed by Parliament on December 21, 2023, and received Presidential assent on December 25, 2023.

The statutes will replace longstanding legal frameworks, signaling a transformative phase in Indian legal history.

The implementation date was set by the Union Government, as stipulated in the laws themselves.

This legislative update represents a pivotal shift in how justice is administered in India, aiming to modernize the legal system.
