Court Acknowledges Health Risks in Pregnancy for Accused
Pregnant woman in murder case receives interim bail from Punjab & Haryana High Court due to health concerns.
DESK – The Punjab & Haryana High Court, under Justice Harkesh Manuja, has granted a three-month interim bail to an eight-month pregnant woman involved in a murder case. The court emphasized the potential health risks and stress associated with detention during pregnancy, which could adversely affect both the mother and the unborn child. Acknowledging the lack of adequate medical care and attention in detention facilities for pregnant women, the court highlighted the importance of accessing proper medical facilities and prenatal care.
The decision came after reviewing the medical report from the Jail Superintendent, which confirmed the woman’s pregnancy with an expected delivery date of March 13, 2024. Justice Manuja noted the paramount concern for the well-being of the unborn child and recognized the necessity of humane treatment for pregnant women facing legal proceedings. The court’s observation underscores the need for a compassionate approach towards pregnant detainees, considering their unique health circumstances.
The woman, accused in a murder case from July 2023, sought interim bail for six months on medical grounds. However, the court granted bail for three months, with an instruction for the petitioner to surrender herself to the Jail Authorities upon the bail period’s expiry.
