MP Dubey’s Election Conduct Case Dismissed by Jharkhand High Court

In a significant ruling, the Jharkhand High Court has dismissed all allegations against Godda MP Dr. Nishikant Dubey, citing a lack of criminal elements in the case.

RANCHI – The Jharkhand High Court, led by Justice Anil Kumar Chaudhary, has quashed four FIRs against Dr. Nishikant Dubey, the MP from Godda.

This decision follows a comprehensive hearing on the criminal quashing petition submitted on Dubey’s behalf.

The court found that the allegations, related to code of conduct violations and inappropriate tweeting during the 2021 Madhupur by-election, did not constitute a criminal case.

Previously, an interim order was issued to prevent any coercive action against Dubey.

Advocates Prashant Pallav and Partha Jalan, representing Dubey, argued that the charges did not amount to a violation of the election code of conduct and sought the FIRs’ cancellation.

Dr. Dubey had challenged the FIRs, contending they were improperly filed and demanding their revocation.

Separately, five FIRs were registered at Deoghar Town police station against Dubey for alleged misstatements during the 2021 Madhupur by-election.

Dubey had also pointed out that the FIRs, filed six months post the incident, were procedurally incorrect as the implicated sections allowed only for complaints, not FIRs.

This judgment marks a pivotal turn in the case, absolving Dubey of the charges and highlighting procedural inaccuracies in the legal process.
