Workers’ Advocate Challenges Financial Claims and Resolution Process

JAMSHEDPUR – The National Company Law Tribunal (NCLT) in Kolkata conducted a hearing on the INCAB company case, unveiling a complex web of financial claims and legal challenges.

"This case highlights the intricate nature of corporate insolvency proceedings," noted a legal expert present at the hearing.

Key Developments:

Vedanta, represented by senior advocate Abhishek Manu Singhvi, proposed a Rs 545 crore investment in INCAB.

Workers’ advocate Akhilesh Srivastava raised critical questions about the validity of financial claims.

NCLT bench decided to hear the workers’ case separately, date to be announced.

Legal Challenges:

Srivastava pointed out the absence of default dates for creditors’ claims, potentially invalidating them under the three-year limitation period.

A discrepancy between current claims exceeding Rs 4000 crore and a 2016 Delhi High Court order fixing INCAB’s liability at Rs 21.63 crore was highlighted.

Questions were raised about the effectiveness of Resolution Professional Pankaj Tibrewal in investigating and recovering company assets.

"The workers’ perspective brings crucial insights to this complex case," Srivastava stated after the hearing.

This development in the INCAB case underscores the challenges in balancing various stakeholders’ interests in corporate insolvency proceedings.

The outcome could have significant implications for INCAB’s future and its workers, as well as broader impacts on corporate insolvency resolution in India.
