MLA Saryu Roy Alleges Bias in Enforcing High Court Orders on Illegal Constructions in Jamshedpur

Jamshedpur Administration Accused of Favoring Influential Builders in Demolition Actions

Allegations have surfaced regarding biased enforcement of the Jharkhand High Court’s demolition orders against illegal constructions in Jamshedpur. Jamshedpur East MLA Saryu Roy accused the district administration and JNAC of partial compliance with the court’s directives.

JAMSHEDPUR – Saryu Roy has made serious allegations of bias on JNAC and the local administration in enforcement of the Jharkhand High Court’s demolition orders against illegal constructions in Jamshedpur.

Addressing a press conference, Jamshedpur East MLA Saryu Roy accused the district administration and Jamshedpur Notified Area Committee of partial compliance with the court’s directives.

Roy claimed that influential individuals are being ignored in the enforcement process.

He pointed out that illegal constructions on plot numbers 52 and 46 of Sakchi Thakurbari Road, and the structure on plot number 122 of Baradwari, are being overlooked despite being on the High Court’s list.

He said that in Sakchi, the ‘Sakchi Pharma’ building was approved for G+2 floors but has five floors with no parking area, violating the map.

Similarly, the ‘Apex Hospital’ building has significant map deviations, and irregular approvals have been granted, he alleged.

Roy also mentioned the building at Regal Chowk by TK Construction, housing enterprises like ‘Croma’ and ‘Oxygen,’ where there are notable irregularities in the map.

Despite this, High Court orders are not being enforced, he said.

He emphasized that section 440 of Jharkhand Bylaws specifies the portion of buildings for parking and setbacks, which are being ignored.

No action is taken against architects who submit wrong maps, and section 438 is not invoked against officials who approve these maps, he added.

The situation is worse in issuing occupancy certificates, with both JNAC and Tata Steel’s Town Division violating rules, he charged.

Roy mentioned meeting advocate Akhilesh Shrivastava and petitioner Rakesh Jha, concluding that there is a bias in implementing High Court orders.

The district administration and Jamshedpur Notified Area Committee are not properly using their powers under the Jharkhand Building Bylaws and Municipality Act, he said.

Roy highlighted the dual municipalities in Jamshedpur, one by the Jharkhand government and the other by Tata Steel, causing public inconvenience.

Tata is reluctant to grant ownership rights outside the lease, while ignoring irregularities within the lease area.

This dual policy harms the public, with illegal building constructions affecting public facilities, he said.

Roy assured advocate Akhilesh Shrivastava and petitioner Rakesh Jha of his readiness to intervene in the relevant High Court case if required in public interest.
