JAMSHEDPUR – A five-day special mediation drive will be held in Jamshedpur under the Mediation for the Nation initiative. District Legal Services Authority (DLSA) started a mobile van campaign to inform citizens about dispute resolution through mediation.
Awareness Through Mobile Van
On Thursday, DLSA launched the campaign in city areas. Volunteers Nagendra Kumar, Dilip Jaiswal, and Joba Rani Baske explained the process of mediation to the public.
Mediation Explained
Mediation is voluntary and confidential. However, both parties themselves decide the terms, not the mediator.
Legal Effect of Settlement
Once signed by both parties and the mediator, the settlement becomes binding like a court decree. Moreover, mediation talks remain private and cannot be presented in court.
Benefits of Mediation
Mediation offers timely solutions within fixed periods. On the other hand, it is less costly than arbitration or litigation.
Besides, it is informal, preserves relationships, and allows flexibility in terms. It also provides scope to modify agreements with mutual consent.
Mediation Procedure
- Courts may refer disputes for mediation.
- Mediator first meets all parties together.
- Mediator then holds separate meetings to reduce conflict.
- Proposals are exchanged through the mediator.
- A written settlement is signed, making it legally enforceable.
Eligible Disputes
Mediation can address:
- Family or matrimonial conflicts
- Consumer grievances
- Employment or workplace disputes
- Property or tenancy issues
- Commercial and contract disputes
- Cheque return matters
- Certain criminal cases
Where to Approach
Citizens may approach court-annexed mediation centres, DLSA secretary, or other authorised mediators. Meanwhile, during ongoing cases, parties may also request courts to refer matters to mediation centres.
Public Reaction
A resident stated, “Mediation avoids long trials and saves resources.” Another said, “This method encourages peaceful settlement between families and neighbours.”
